1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the LocateX mobile application, the LocateX web application at app.locatex.tech, and related services (together, the "Service"), operated by Initop Solutions ("LocateX", "we", "us"). By creating an account or using the Service, you agree to these Terms.

2. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without authorization.

3. Acceptable Use

You agree to use the Service only for lawful purposes, and only to monitor vehicles you own or are authorized to track. You agree not to use the Service to track a vehicle or person without proper authorization, and not to attempt to interfere with, disrupt, or gain unauthorized access to the Service or its systems.

4. GPS/Device Limitations

LocateX displays location and status data reported by third-party GPS tracking hardware installed in your vehicle. GPS accuracy, update frequency, and data availability depend on that hardware, its cellular/network connectivity, satellite visibility, and other factors outside our control. Location data may be delayed, temporarily unavailable, or occasionally inaccurate.

5. Vehicle Tracking

The Service is intended to help you monitor vehicles connected to your account. You are responsible for ensuring you have the legal right to track any vehicle associated with your account.

6. Third-Party Hardware/Network Dependency

The Service depends on third-party GPS tracking devices and the mobile/cellular networks they use to transmit data. We do not manufacture this hardware and are not responsible for its performance, availability, or failure, or for network outages affecting data transmission.

7. Vehicle Commands

On supported, connected devices, LocateX may allow you to send commands to your vehicle's tracking hardware (for example, engine lock/unlock). Sending a command through the Service means it has been transmitted toward the device — it does not guarantee the device received it, executed it, or executed it immediately. Confirmation may be delayed, and command support varies by device and vehicle. Use vehicle commands responsibly and only when it is safe to do so.

8. Service Availability

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or reasons outside our control.

9. Account Suspension

We may suspend or terminate access to the Service if we reasonably believe these Terms have been violated, or as needed to protect the security or integrity of the Service, its users, or third parties.

10. Service Changes

We may modify, update, or discontinue features of the Service over time. We will make reasonable efforts to communicate significant changes that affect your use of the Service.

11. Limitation of Liability

The Service is provided "as is." To the fullest extent permitted by law, LocateX and Initop Solutions are not liable for indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service — including damages related to GPS inaccuracy, delayed or missed alerts, device/network unavailability, or vehicle commands not being executed as expected.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
